U.S. Court of Appeals Case No: 12-3995
U.S. District Court for the Eastern District of Arkansas - Little Rock
[PUBLISHED] [Gruender, Author, with Riley, Chief Judge, and Bye, Circuit
Judge]
Criminal case - Criminal case. The district court did not err in finding
that officers saw marijuana in plain view when they entered defendant's
residence or in concluding that a search had not taken place until after
the officers secured a warrant; evidence was sufficient to support
defendant's conviction for possession of crack with intent to distribute;
hearsay challenge to admission of an officer's out-of-court statement
rejected. Judge Riley, concurring.
