[PUBLISHED] [Wollman, Author, with Riley, Chief Judge, and Shepherd, Circuit Judge] Civil case - National Football League. Where the NFL Players' Association and law firms authorized to represent NFL players settled and dismissed their 2011 lawsuit alleging the League had violated the parties' 1993 Stipulation and Settlement Agreement by instituting a secret cap on players' salaries, the district court did not err in denying a motion to set aside the the dismissal and reopen the case based on a claim that the dismissal was invalid because the district court never approved it as required by Fed. R. Civ. P. 23(e); Rule 23(e) does not apply because the claims settled in the dismissal were not the claims of a certified class; however, the district court erred in prohibiting the White plaintiffs from seeking relief from the dismissal under Rule 60(b) on the ground that a Rule 41(a)(1)(A)(ii) dismissal does not constitute a judgment order or proceeding under Rule 60(b); the court joins six other circuits which have held such a dismissal is a judgment order or proceeding for purposes of Rule 60(b), and the matter is remanded for further proceedings.
