   the district court erred in denying the Tribe's motion to dismiss based on 
   plaintiff's failure to exhaust its tribal court remedies with respect to 
   plaintiff's challenge of the tribal courts' jurisdiction; this part of the 
   claim is remanded with directions to dismiss the complaint; the district 
   court's dismissal of other claims for failure to exhaust is affirmed.
