131607P.pdf 03/21/2014 Fernando Espinoza v. United States
U.S. Court of Appeals Case No: 13-1607
U.S. District Court for the Northern District of Iowa - Sioux City
[PUBLISHED] [Bye, Author, with Murphy and Smith, Circuit Judges] Prisoner case - Habeas. District court did not err in rejecting Espinoza's claim that counsel was ineffective for failing to object to imposition of an enhancement under Section 851 as the error in the 851 notice was a clerical error naming the wrong district court for his prior conviction and Espinoza still had reasonable notice of the government's intent to rely on a particular conviction; as the notice was adequate, counsel was not ineffective in failing to object to it.
