U.S. Court of Appeals Case No: 13-1660
and No: 13-1661
U.S. District Court for the Eastern District of Arkansas - Little Rock
[PUBLISHED] [Benton, Author, with Gruender and Kelly, Circuit Judges]
Criminal case - Criminal law and sentencing. No error in admitting expert
testimony on the iconography of the Mexican drug underworld, including
information on Jesus Malverde; no error in denying an instruction limiting
the admission of this testimony to other defendants as it went to the
existence of the conspiracy; evidence was sufficient to support
defendant's conviction for conspiracy to distribute cocaine; court did not
err in finding defendant could reasonably foresee the distribution of 500
grams or more of meth. Judge Kelly, concurring.
