U.S. Court of Appeals Case No: 13-2061
U.S. District Court for the Western District of Arkansas - Hot Springs
[PUBLISHED] [Wollman, Author, with Loken and Kelly, Circuit Judges]
Civil case - Insurance. The district court did not err in applying
Arkansas's doctrine of mutual mistake to reform an insurance policy where
the policy inadvertently failed to include a law enforcement exclusion, as
the evidence showed both the insured and the insurer intended to enter
into a contract which excluded such coverage; defendant's laches argument
was without merit.
