U.S. Court of Appeals Case No: 13-2176
Petition for Review of an Order of the Board of Immigration Appeals
[PUBLISHED] [Colloton, Author, with Smith and Gruender, Circuit Judges]
Petition for Review - immigration. Substantial evidence supported
immigration judge's finding that Goswell-Renner gave false testimony
relating to her marital status at her adjustment-of-status hearing and
thus did not demonstrate good moral character. Goswell-Rennrer only
asserted a derivative claim that her child would be subjected to female
genital mutilation upon return to Gambia in support of her claim for
withholding of removal and not a claim of direct persecution. An applicant
may not establish a derivative claim for withholding of removal based upon
the applicant's child's fear of persecution. Petition for review of denial
of cancellation of removal and withholding of removal is denied.
