U.S. Court of Appeals Case No: 13-2188
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Benton, Author, with Bye and Melloy, Circuit Judges]
Criminal case - Sentencing Guidelines. District court did not err in
applying the terrorism enhancement of Guidelines Sec. 3A1.4 as defendant's
admissions were sufficient to show his felony was calculated to influence
or affect the conduct of the government; district court did not err in
relying on co-defendants' trial transcripts at sentencing; no error in
finding defendant obstructed justice by making a material misstatement to
his probation officer and forfeited his acceptance-of-responsibility
reduction; sentence was not unreasonable and did not create unwarranted
disparities with his co-defendants.
