U.S. Court of Appeals Case No: 13-2287
U.S. District Court for the District of South Dakota - Sioux Falls
[PUBLISHED] [Kelly, Author, with Colloton and Shepherd, Circuit Judges]
Criminal case - Criminal law and sentencing. Warrant provided sufficient
detail for the officers to know the items to be seized; defendant's
evidentiary challenges rejected; claims of ineffective assistance of
counsel would not be considered on direct appeal; imposition of sentences
for obstruction of sex trafficking enforcement and sex trafficking did not
violate defendant's right against double jeopardy as the court grouped the
counts under Guidelines Sec. 3D1.2(c) and imposed concurrent sentences;
factoring an uncharged count of sex trafficking into defendant's
sentencing calculations did not violate his Sixth Amendment rights.
