U.S. Court of Appeals Case No: 13-2362
U.S. District Court for the Western District of Missouri - Jefferson City
[PUBLISHED] Civil case - Insurance. In action alleging plaintiff's insurer
acted in bad faith by failing to settle a third-party claim against
plaintiff within the policy limits, the district court did not err in
granting summary judgment for the insurer as its attempt to reach a global
settlement was not evidence of bad faith and it properly filed an
interpleader action to divide the available policy limits as soon as it
was clear that it could not reach a global settlement given the
conflicting claims against plaintiff; nor was there evidence that the
insurer had a reasonable opportunity to settle the largest claim within
the policy limits.
