[PUBLISHED] [Kelly, Author, with Murphy and Colloton, Circuit Judges] Criminal Case - conviction. Following conviction for conspiring to commit bank robbery, and weapons possession, the district court did not err in denying motion for judgment of acquittal or abuse its discretion in denying motion to a new trial based on sufficiency of evidence of conspiracy when coconspirator was acquitted, as there was sufficient evidence to support conspiracy conviction. District court did not abused its discretion in admitting evidence of Bassett's prior conviction for bank robbery, as it was sufficiently similar to the planned robbery to be admissible under Rule 404(b), was probative of his intent, and was not unduly prejudicial. In addition, a limiting instruction was issued.
