Civil case - Civil Rights. The district court erred in denying the
defendant police officer's motion for summary judgment based on qualified
immunity; the officer established beyond genuine factual dispute that
plaintiff was intoxicated at the time of her arrest and presented some
danger to herself; as the law regarding whether defendant had probable
cause to arrest plaintiff in his capacity as a community caretaker and
take her to a detox center was not clear at the time of plaintiff's
arrest, defendant did not violate a clearly established constitutional
right and was entitled to qualified immunity; defendant was also entitled
to qualified immunity on plaintiff's state-law battery and false
imprisonment claims.
