U.S. Court of Appeals Case No: 13-2782
U.S. District Court for the Eastern District of Arkansas - Pine Bluff
[PUBLISHED] [Colloton, Author, with Smith and Gruender, Circuit Judges]
Civil case - ERISA. The insurer's interpretation of the Plan - that a
claimant had to produce evidence that he was physically or mentally
incapable of performing the duties of his occupation - was reasonable;
while plaintiff lost his over-the-road truck license as a result of his
diabetes mellitus, that by itself, was not enough to justify benefits; the
insurer's determination that plaintiff was not totally disabled is
supported by substantial evidence and the decision to deny benefits was
reasonable. Judge Smith, dissenting.
