U.S. Court of Appeals Case No: 13-3085
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Shepherd, Author, with Wollman and Bye, Circuit Judges]
Criminal case - Criminal law. Assuming for the purposes of this analysis
that the police officers' warrantless entry into defendant's home was not
justified by exigent circumstances and was a Fourth Amendment violation,
defendant's subsequent consent to search was an act of free will
sufficient to purge the taint of the claimed Fourth Amendment violation.
Judge Bye, dissenting.
