Where defendant erroneously informed plaintiff's health care providers that she no longer had insurance coverage, her state court contract and negligence claims were preempted by ERISA; however, the district court erred in finding the the complaint was barred by a one-year limitations periods in the insurance policy, and the matter is remanded for further consideration of whether the three-year limitations period from another provision applies.
