U.S. Court of Appeals Case No: 13-3327
U.S. District Court for the Western District of Arkansas - Ft. Smith
[PUBLISHED] [Murphy, Author, with Colloton and Kelly, Circuit Judges]
Civil case - Personal Injury. No abuse of discretion in denying
plaintiff's fifth motion to amend his complaint; plaintiff failed to
establish that defendant owed him any duty of care as Arkansas' exception
to the rule that a landowner does not owe a business invitee a duty if a
danger is known or obvious did not apply since plaintiff was not required,
as a practical matter, to encounter the danger in order to perform his
job; further, defendant had no duty to warn plaintiff, a master sign
electrician, of obvious hazards integral to his work.
