U.S. Court of Appeals Case No: 13-3481
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Bright, Author, with Colloton and Shepherd, Circuit Judges]
Criminal case - Criminal law and sentencing. Defendant was coherent and
responsive when he made his post-Miranda statements and there was no
evidence that he was coerced or threatened; as a result, the statements
were admissible because he had voluntarily and knowingly waived his
rights; district court did not err in denying a motion to reopen the
suppression hearing based on the discovery of a video as the video
supported the court's earlier conclusions; no error in sentencing
defendant as an armed career criminal; sentence was not substantively
unreasonable.
