U.S. Court of Appeals Case No: 13-3785
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Shepherd, Author, with Bright and Colloton, Circuit Judges]
Civil case - Americans with Disabilities Act. In an action claiming
plaintiff's suspension of driving privileges based on several DWI offenses
was a violation of the ADA, plaintiff did not allege in his complaint
facts which would support a finding that he has a disability as defined by
the ADA; the fact that he was arrested several times for DWI did not, in
itself, establish that plaintiff was an alcoholic; nor did plaintiff
establish that the state treated him as an alcoholic.
