[PUBLISHED] [Benton, Author, with Murphy and Melloy, Circuit Judges] Civil case - Employment discrimination. The defendant had not met its burden of articulating a nondiscriminatory justification for its reliance on plaintiff's retirement eligibility in making its hiring decision, and the district court erred in granting the defendant's motion for summary judgment on plaintiff's age discrimination claim; plaintiff met his burden of showing the defendant's reasoning for its hiring decision, that an outside candidate was most qualified, may be a pretext for age discrimination; under the circumstances, where the decision makers thought the chosen candidate would stay in the position for at least seven years while plaintiff was eligible for immediate retirement, the age difference between the candidates, while only 8 years, was substantial; remanded for further proceedings.
