U.S. Court of Appeals Case No: 14-1737
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Colloton, Author, with Riley, Chief Judge, and Kelly, Circuit
Judge]
Civil case - Cable Communications Policy Act. In suit alleging defendant
retained plaintiff's personally identifiable information in violation of
47 U.S.C. Section 551(e), the district court did not err in dismissing the
action for lack of Article III standing; under the Supreme Court's recent
decision in Spokeo, Inc. v. Robins, 136 S. Ct. 1540 (2016), Article III
requires a concrete injury, even in the context of a statutory violation,
and plaintiff failed to allege an injury in fact as required by Article
III.
