U.S. Court of Appeals Case No: 14-1749
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Smith, Author, with Benton and Shepherd, Circuit Judges] Civil Case - diversity - contract. In claim for breach of contract in which Chavis Van & Storage claimed it was not assigned the role of origin agency and destination agent by United Van Lines, the grant of summary judgment to United is affirmed. The agency agreement is not ambiguous. None of documents Chavis identifies support that it is the only "authorized" agent to its home market for non-military shipments or the exclusive agent for military shipments, and thus United did not breach the agreement. The district court did not abuse its discretion in denying the motion to compel discovery.
