Civil case - Family Medical Leave Act. There was an issue of material fact
as to whether plaintiff was restored from leave before being terminated,
and the district court erred in granting summary judgment to the defendant
employer on plaintiff's claim that the employer denied his exercise of his
FMLA rights; there was also a genuine issue of material fact as to whether
defendant's ground for terminating plaintiff was a pretext for
discrimination based on his use of FMLA leave; reversed and remanded for
further proceedings.
