U.S. Court of Appeals Case No: 14-2270
U.S. District Court for the Southern District of Iowa - Davenport
[PUBLISHED] Riley, Author, with Loken and Shepherd, Circuit Judges] Civil case - Insurance. The district court did not err in denying Michigan Millers' post-trial motion for judgment as a matter of law as the evidence supported the jury's verdict that Michigan Millers' was not prejudiced by Asoyia's delay in providing it notice of a fire claim, as there was detailed evidence from which the jury could conclude that defendant insurer United Fire had rebutted the presumption of prejudice which attaches to delay; the district court did not err in deciding the policies in question between Michigan Millers and Aosyia were ambiguous and that defendant Jennings, Asoyia's former chief executive, was covered.
