U.S. Court of Appeals Case No: 14-2557
U.S. District Court for the Northern District of Iowa - Sioux City
[PUBLISHED] [Loken, Author, with Riley, Chief Judge, and Shepherd, Circuit
Judge]
Criminal case - Sentencing. Though Iowa classified third-degree burglary
as an aggravated misdemeanor, it was punishable by two years in prison and
thus defendant's Iowa conviction for the offense was a felony as that term
is used in 8 U.S.C. Sec. 1326(b)(1).
