U.S. Court of Appeals Case No: 14-3051
U.S. District Court for the Western District of Missouri - Springfield
[PUBLISHED] [Smith, Author, with Riley, Chief Judge, and Loken, Circuit
Judge]
Civil case - Civil Procedure. The district court did not err in applying a
six-factor test to determine whether a party has colluded to manufacture
diversity as the test allowed it to sufficiently address factors relevant
to whether an assignment of a legal claim functioned as part of scheme to
manufacture diversity; nor did the court err in determining that plaintiff
collusively manufactured diversity for the purpose of bringing suit in
federal court.
