plaintiff's motion to remand the case to state court based on its finding
plaintiff had fraudulently joined the McKee defendants because there was
no reasonable basis in fact and law to support a claim against them; for
res judicata purposes there is now a final judgment in the case the
district court relied on to establish res judicata, and any error in
relying on that decision before there was a final decision was harmless.
