U.S. Court of Appeals Case No: 14-3723
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Smith, Author, with Colloton, Circuit Judge, and Erickson,
District Judge]
Prisoner case - Prisoner civil rights. In action alleging defendants were
deliberately indifferent to plaintiff's need for dentures, the district
court did not err in granting summary judgment to the Director of
Corrections and the Medical Director defendants; there was no evidence
that the officials were deliberately indifferent to plaintiff's medical
need for dental care by failing to address a shortage of dentists in the
prison; during the time plaintiff waited for dentures, defendants made
regular efforts to hire more dentists and the shortage of dentists was not
a product of their conduct and could not be characterized as deliberate
indifference on their part.
