Civil case - Federal Employees Health Benefits Act. A provision of the
Act, 5 U.S.C. Section 8902(m)(1), expressly preempts Bell's Arkansas state
law defense regarding reimbursement of any benefits received under her
benefit plan, and Bell must reimburse the Plan from the settlement she
received from a different carrier that insured the party who was allegedly
responsible for her injury.
