[PUBLISHED] [Murphy, Author, with Benton and Kelly, Circuit Judges] Civil Case - Diversity. In negligence action against Amtrak, the circumstantial evidence supports inference that Haukereid accidentally fell out of the right side exit door on the train and the record does not support that Amtrak proximately caused his death. There is no evidence showing who may have opened the exit door, and failure to install door status indicators or to instruct its crew on hazards of confused passengers was not the proximate cause of his death. Jury may not indulge in multiple presumptions to establish facts to support Haukereid. District court did not err in granting summary judgment to Amtrak. The district court did not abuse its discretion by denying discovery requests. Judge Kelly dissents.
