[PUBLISHED] [Kressel, Author, with Saladino and Shodeen, Bankruptcy Judges] Bankruptcy Appellate Panel - section 523(a)(6). Twister's Iron Horse Saloon failed to obtain a public performance license from the American Society of Composers, Authors and Publishers and was sued for copyright infringement. A default judgment was entered against Twister's. ASCAP filed an adversary action in Twister's bankruptcy case claiming its debt was nondischargeable because the debtor's actions were willful and malicious. The bankruptcy court's findings that Twister's intentionally ignored ASCAP's correspondence and attempts to contact it are not clearly erroneous. Twister's actions go beyond mere recklessness and are willful. Twister's action are also malicious. The judgment of the bankruptcy court is affirmed.
