U.S. Court of Appeals Case No: 15-1183
and No: 15-1665
and No: 15-1832
U.S. District Court for the Western District of Missouri - Joplin
[PUBLISHED] [Kelly, Author, with Murphy and Benton, Circuit Judges]
Civil case - Family Medical Leave Act. The district court did not clearly
err in making its factual determination that, at the time defendant fired
him, plaintiff's decedent's back condition met the objective requirement
of a chronic condition and a serious health condition for purposes of the
Act; no error in awarding liquidated damages where the employer failed to
show the good faith exception applied; attorneys' fees award affirmed; on
plaintiff's cross-appeal, the district court erred in finding that
defendant met its burden under the after-acquired evidence doctrine and
the matter is remanded for further proceedings regarding plaintiff's
damages.
