U.S. Court of Appeals Case No: 15-1219
U.S. District Court for the Eastern District of Arkansas - Little Rock
[PUBLISHED] [Gruender, Author, with Riley, Chief Judge, and Bye, Circuit
Judge]
Civil case - Contracts. The district court erred in dismissing the
plaintiffs' claims that defendant violated the wage term of their
employment by paying them less than the hourly prevailing wage mandated by
20 C.F.R. Section 655.20 and that defendant had willfully filed W-2 forms
containing fraudulent information regarding their earnings in violation of
26 U.S.C. Sec. 7434 as the complaint stated a claim on both counts; the
court's decision not to exercise supplemental jurisdiction over
plaintiffs' Arkansas minimum wage claims is also reversed.
