[PUBLISHED] [Melloy, Author, with Wollman and Colloton, Circuit Judges] Civil case - Employment discrimination. Where plaintiff had supported defendant's opponent in the election for the position of Circuit Clerk, it was permissible under the First Amendment for defendant to dismiss plaintiff as chief deputy clerk after the election on the ground the position as defendant structured it required personal and political loyalty; plaintiff did not timely appeal her Government Employees Rights Act claim to this court and it would not be considered; assuming plaintiff established a prima facie case of gender discrimination regarding defendant's failure to reappoint her, plaintiff failed to show defendant's stated hiring grounds were pretexts; with respect to appointment to another position, plaintiff did not apply for any open positions and could not state a prima facie case; with respect to plaintiff's retaliation claim under the first Amendment, the evidence showed the person hired had greater relevant experience, and the district court did not err in granting defendant's motion for summary judgment.
