Civil case - Fair Debt Collection Practices Act. When a lawyer files a
complaint for unpaid rent and possession, Missouri law requires that a
verified affidavit be filed setting forth the basis for the debt, and a
lawyer's act in submitting the affidavit based on information provided by
the landlord does not violate the FDCPA because the information, even if
not personally known by the lawyer, did not mislead the state court in any
meaningful way as the court heard evidence before rendering judgment.
