U.S. Court of Appeals Case No: 15-1574
U.S. District Court for the Northern District of Iowa - Dubuque
[PUBLISHED] [Gruender, Author, with Chief Judge Riley and Melloy, Circuit
Judges]
Criminal Case - sentence. Imposition of role enhancement under USSG sec.
3B1.1(b) was not clear error, as evidence supported counting supplier of
pseudoephedrine as a participant who knowingly provided aid to the
criminal enterprise. No plain error in counting defendant?s wife as
participant, as wife had previously purchased pseudoephedrine, allowed her
husband to manufacture methamphetamine in their shared apartment, and had
fled the apartment when the fire broke to avoid responsibility.
