Criminal Case - conviction. District court did not err in denying motion
to dismiss indictment without an evidentiary hearing and did not err in
denying the motion to dismiss based on alleged due process violations. The
district court properly rejected her due process claim that was based on a
fallacious legal argument that she had a right to withdraw her application
for admission at the border and her uncontested factual assertion that she
would have exercised that right had she been properly advised. Conviction
for illegally entering United States is affirmed.
