U.S. Court of Appeals Case No: 15-1732
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Shepherd, Author, with Colloton and Gruender, Circuit Judges]
Civil case - Civil rights. In action alleging jail officials acted with
deliberate indifference to his medical needs by failing to provide care
for his broken hand suffered prior to his arrest and detention, plaintiff
did receive treatment for the hand, and his claim did not rise to the
level of deliberate indifference; further, plaintiff concedes the delay in
treatment did not cause him to suffer a detrimental effect and summary
judgment for the defendant nurse was appropriate; plaintiff failed to show
the defendant jail administrator was actually aware of a serious medical
need and disregarded it; without a constitutional violation by any
individual, the claims against the City and county fail.
