U.S. Court of Appeals Case No: 15-1878
U.S. District Court for the District of Nebraska - Omaha
[PUBLISHED] [Loken, Author, Wollman and Bye, Circuit Judges]
Civil case - Contracts. Under the provisions of the contract between
plaintiff and GC which provided for commissions to plaintiff on any
awarded contract and renewals between GC and customers plaintiff found for
GC, plaintiff was not entitled to fees on a new contract negotiated
between GC and a third party initially referred by plaintiff, as the new
agreement between GC and the third party was not a renewal term of their
previous contract; as the contract provision at issue was not ambiguous,
the district court properly excluded extrinsic evidence.
