U.S. Court of Appeals Case No: 15-2058
U.S. District Court for the Northern District of Iowa, Waterloo
[PUBLISHED] [Riley, Author, with Loken and Shepherd, Circuit Judges]
Civil case - Employment discrimination. Plaintiff failed to adduce any
evidence that race was a motivating factor in his employer's decision to
discipline him for failing to follow instructions concerning the operation
of his machine and for producing defective parts; plaintiff's proffer of
unsworn and unattested statements from co-workers and his related
interrogatory answers did not meet the standards of Rule 56(c)(4), and the
district court did not err in granting the employer summary judgment on
plaintiff's harassment claim.
