U.S. Court of Appeals Case No: 15-2590
U.S. District Court for the Southern District of Iowa - Davenport
[PUBLISHED] [Benton, Author, with Murphy and Smith, Circuit Judges]
Criminal case - Criminal law. The totality of the circumstances - a known
felon and gang member reported to be in possession of a gun, walking
quickly through a high-crime area and suspiciously looking around - as
well as the police officers' knowledge that defendant's fellow gang member
and close friend had been shot a few hours before, supported the officers'
reasonable suspicion that defendant was in possession of a firearm, and
the district court erred in suppressing a gun found during a pat-down
search.
