U.S. Court of Appeals Case No: 15-2795
U.S. District Court for the Northern District of Iowa - Cedar Rapids
[PUBLISHED] [Loken, Author, with Beam and Smith, Circuit Judges]
Criminal case - Sentencing. 18 U.S.C. Sec. 3582 does not entitle a
defendant to a sentencing reduction, and the court did not abuse its
discretion in denying defendant's request for an Amendment 782 reduction;
it is defendant's burden to establish that his situtation warrants a Sec.
3582(c)(2) reduction, and the court may consider the lack of positive
post-sentence information in denying a reduction.
