U.S. Court of Appeals Case No: 15-2829
U.S. District Court for the Eastern District of Arkansas - Little Rock
[PUBLISHED] [Loken, Author, with Gruender and Kelly, Circuit Judges]
Civil case - Social Security. Substantial evidence supported the ALJ'
residual functional capacity determination; the ALJ's residual functional
capacity determination accounted for claimant's mental impairments by
limiting him to jobs involving simple, repetitive tasks with limited
interpersonal contact and direct, concrete supervision; the ALJ's
determination also accounted for claimant's physical impairments; no error
in discrediting claimant's subjective complaints given the medical record,
his failure to seek treatment and his daily activities; contrary to
claimant's argument, the ALJ specifically noted that claimant had been
declared permanently and totally disabled by the VA and correctly noted
that such a determination was not binding on the Commissioner. Judge
Kelly, dissenting.
