U.S. Court of Appeals Case No: 15-2837
U.S. District Court for the Eastern District of Missouri - Cape Girardeau
[PUBLISHED] [Gruender, Author, with Smith, Circuit Judge, and Ketchmark,
District Judge]
Criminal case - Criminal law. The arresting officer had a reasonable
suspicion that defendant was trafficking in drugs and this suspicion
justified the extension of the traffic stop for roughly twenty minutes
until a drug dog could arrive and conduct a sniff search; even though
defendant refused to sign the Miranda waiver form, he knowingly,
intelligently and voluntarily waived his Miranda rights by acknowledging
that he understood them and by agreeing to speak to the officers and
discuss his offense.
