Petition for Review - Immigration. Since this court's decision in
Hernandez v. Holder, 606 F.3d 900 (8th Cir. 2010), the BIA has supplied a
useable standard for reviewing denials of motions for administrative
closure, and the court joins other circuits which have held that circuit
courts have jurisdiction to review the denials of motions for
administrative closure; the IJ did not abuse her discretion in denying
petitioner's motion for administrative closure; the BIA did not consider
petitioner's request that the Board exercise its independent authority to
grant administrative closure, and the matter is remanded for the Board to
consider whether petitioner's request warrants a favorable exercise of the
BIA's discretion.
