U.S. Court of Appeals Case No: 15-3449
U.S. District Court for the Northern District of Iowa, Waterloo
[PUBLISHED] [Gruender, Author, with Loken and Benton, Circuit Judges]
Criminal case - Criminal law. Evidence was sufficient to support
defendant's conviction for unlawful use of identification documents and
misuse of a social security number; defendant failed to raise his
selective prosecution argument in a pretrial motion - see Fed. R. Crim. P.
12(b)(3)(A)(iv) - and thereby waived the defense; because defendant waived
this defense, the district court did not abuse its discretion by refusing
to admit evidence related to the defense.
