U.S. Court of Appeals Case No: 15-3804
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Wollman, Author, with Arnold and Kelly, Circuit Judges]
Civil case - Contracts. Under the provisions of the contract governing
defendant's processing of plaintiff's credit card transactions,
plaintiff's liability for a data breach which compromised cardholder data
was limited to $500,000; the district court did not err in limiting
plaintiff's loss to that amount and ordering defendant to return funds
held in excess of the cap; district court did not abuse its discretion in
denying defendants' motion for reconsideration or leave to amend under
Rule 54(b).
