Civil case - Civil rights. In action by court employee alleging she was
fired in retaliation for voting for the circuit clerk's opponent, the
defendants have not established that she would have been fired in any
event for performance issues, and they are not entitled to summary
judgment under Mt. Healthy City School District Board of Education v.
Doyle, 429 U.S. 274 (1977); the court would not rule on an issue regarding
qualified immunity as that claim was raised was not decided by the
district court and can be decided by the district court on remand; the
Eleventh Amendment does not bar plaintiff's claim against defendant Reuter
in his official capacity for equitable, prospective relief, including
declaratory relief and reinstatement; the district court did not err in
granting summary judgment for defendant Wes and defendant Jefferson County
as plaintiff's evidence failed to establish the necessary causal
connection between the alleged misconduct and the official sued.
