Civil case - Americans with Disabilities Act. In action alleging exterior
barriers to an office building violated the ADA and the Minnesota Human
Rights Act and constituted a bias offense under Minnesota Statutes Sec.
611A.79, the district court correctly determined plaintiff Wong made a
sufficient showing of actual injury to establish standing at the summary
judgment stage of the case; concerning the merits, defendants met any
applicable burden to establish that removal of the barriers was not
readily achievable and plaintiff failed to refute the evidence, and the
district court did not err in granting defendant's motion for summary
judgment; on the same analysis, the district court did not err in granting
defendant summary judgment on the MHRA claim; since a finding that the
defendant committed a bias offense is dependent on a finding that the
defendant violated the MHRA, the court properly dismissed this claim.
