Civil case - Abortion. The district court failed to make factual findings
estimating the number of women burdened by the provisions of Arkansas's
Abortion-Inducing Drugs Safety Act before entering a preliminary
injunction preventing the enforcement of the Act, which requires
medication-abortion providers to contract with a physician who has
hospital admitting privileges; the preliminary injunction is vacated and
the matter is remanded for further proceedings; on remand the district
court should conduct fact finding concerning the number of women unduly
burdened by the contract-physician requirement and determine whether the
number constitutes a "large fraction" under the applicable Supreme Court
case law.
