a witness that government could have failed to disclose; assuming the
state's decision to make certain relocation payments to a witness was
Brady information, the failure to disclose it does not undermine the
confidence in the verdict; Kennell defaulted any claims that he may have
had concerning the witness's testimony regarding a gun used in the crime;
the district court did not err in finding there was no "non-prosecution"
agreement with certain witnesses and the failure to disclose a
